Author: Ricardo Alberto Antequera, Estudio Antequera Parilli & Rodriguez

Last May 11th, 2006 the Venezuelan Supreme Court published a decision by means of which they ordered a national TV station, to suspend broadcasting of supposedly pornographic advertising.

The issue emerged after an individual filed a constitutional action before the Supreme Court, against the advertising transmitted by such TV station after 1: 00 am, which shows naked women offering their services by means of sending SMS or by calling to the phone numbers shown on the screen, seeking constitutional protection over family values and children's rights.

This kind of advertising is strictly forbidden by the Radio and TV Social Liability Law, which prohibits any programming, including advertising, containing explicit sexual content.

This decision is a preliminary injunction taken while the action is decided. CONATEL, the national office in charge of the observance of the dispositions of the Radio and TV Social Liability Law, was also summoning to this case.
