Korean Fair Trade Commission issues corrective order to 15 cyber mall operators

On May 2006, the Korea Fair Trade Commission (KFTC) issued a corrective order not to use a certified standard form contract mark (hereinafter the “certified mark”) to 15 cyber mall operators, who indeed had not used the standard form contracts prepared and certified by the KFTC but used the certified mark in their websites anyway providing false and misleading information to customers. The Regulation of Standard Contract Act provides that the KFTC shall be authorized to develop standard contracts using the certified mark, or the KFTC’s logo, in order to facilitate the use of the KFTC standard contracts. In this case, however, the cyber malls’ adhesion contracts bearing the certified mark largely differ from the certified standard form contract of KFTC. For example, the instant adhesion contracts of 15 cyber malls permit collected personal information of customers to be exploited by other telemarketers, or unreasonably limit the power of revocation of customers.
